Our client was a permanent resident from Australia. He was working as an Executive Chef at a prominent restaurant when he went out with friends on a weekend. An argument ensued and the police were contacted. When the group was placed under arrest for causing a disturbance, officers found cocaine on P’s person. Mr. G. was engaged to a Canadian Citizen and avoiding a drug related conviction was a necessity. Mr. Wyman identified numerous issues in the disclosure material which called into question the legitimacy of the arrest. Should the arrest be deemed unlawful, the drugs that were subsequently found would be excluded from evidence. Crown Counsel agreed and the charges were withdrawn early on in the proceedings.
